  4. Contact Information: Information reasonably sufficient to allow us to contact you, including your full legal name, physical address, telephone number, and email address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy & Perjury Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. What Happens After We Receive a Notice

Upon receipt of a valid and complete DMCA notice:

  • We will review the submission to verify that it meets the legal requirements of 17 U.S.C. § 512(c)(3).
  • If the notice is complete and valid, we will expeditiously remove or disable access to the allegedly infringing material.
  • We will make a reasonable attempt to notify the party responsible for posting or hosting the affected content that it has been removed.
  • We aim to acknowledge and process all complete notices promptly, typically within 24 to 72 business hours.

4. Counter-Notification

If material you posted was removed or disabled as a result of a DMCA takedown notice and you believe this was done in error or because of a misidentification, you have the right under 17 U.S.C. § 512(g)(2) and (3) to submit a formal Counter-Notification.

What your counter-notice must include

To be effective under the DMCA, a Counter-Notification must be in writing and include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, physical address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original takedown notice.

What happens next

When we receive a valid Counter-Notification, we will provide a copy to the original complaining party, informing them that we may replace the removed material in 10 business days. Unless the original complainant notifies us that they have filed an action seeking a court order within 10 to 14 business days, we may restore the removed material.

5. Repeat Infringers

In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances and at our sole discretion, access or privileges for users or contributors who are determined to be repeat infringers.

6. False Claims and Misrepresentation

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that it was removed or disabled by mistake or misidentification, may be subject to substantial liability.
